Terms & Conditions

These Terms & Conditions apply to all bookings, services, equipment hire, entertainment, performances and related services supplied by Mersey Entertainment (“we”, “us”, “our”) to the person or organisation making the booking (“you”, “the Client”).

By making a booking with us, you agree to these Terms & Conditions.

1. OUR SERVICES

1.1 Mersey Entertainment provides a range of entertainment, event equipment, hire and related services, which may include DJs, dancefloors, photobooths, illuminated letters and numbers, event lighting, children's entertainment, face painting, candyfloss, popcorn, slush, hot dog machines and other event services.

1.2 The exact services supplied will be those confirmed on your invoice, booking confirmation or other written agreement.

1.3 Where a service is supplied by a third-party performer, contractor or supplier, additional terms may apply.

2. WHEN A BOOKING BECOMES CONFIRMED

2.1 A booking is not confirmed until we have accepted the booking and the required deposit has been paid, unless otherwise agreed in writing.

2.2 Payment of a deposit constitutes acceptance of these Terms & Conditions.

2.3 We reserve the right to decline a booking before confirmation.

2.4 Verbal discussions or provisional enquiries do not constitute a confirmed booking unless expressly confirmed by us in writing.

3. QUOTATIONS AND PRICES

3.1 Quotations are based on the information provided to us at the time of enquiry.

3.2 A quotation may change if the requirements of the booking change, including changes to venue, timings, guest numbers, equipment, access, services or other requirements.

3.3 Unless otherwise stated, quotations do not guarantee availability until the booking has been confirmed.

3.4 Prices confirmed on an invoice or booking confirmation will apply to the agreed services.

3.5 Additional services requested after confirmation may incur additional charges.

4. DEPOSITS AND PAYMENTS

4.1 The required deposit will depend on the services booked and may be £50 or up to 50% of the total booking value, as specified on the invoice or booking confirmation.

4.2 The deposit secures the date and services for the Client and may prevent us from accepting other bookings for the same date.

4.3 Unless otherwise stated on the invoice, the remaining balance is due 28 days before the event date.

4.4 Where a different final payment date is stated on the invoice, that date will apply.

4.5 We may issue reminders for outstanding balances. Failure to make payment by the required deadline may constitute a breach of these Terms & Conditions.

4.6 We reserve the right to cancel or suspend a booking where payment remains outstanding, subject to applicable law and the cancellation provisions below.

4.7 Payment of the deposit and/or any balance confirms acceptance of these Terms & Conditions.

5. CANCELLATION BY THE CLIENT

5.1 If you cancel a confirmed booking, cancellation charges will apply according to how close the cancellation is to the event date.

5.2 Our cancellation policy is:

Time of cancellationAmount payable/retained

More than 12 weeks before the eventThe deposit is retained and is not refundable, subject to applicable law

More than 8 weeks but 12 weeks or less before the event50% of the total booking price is payable

8 weeks or less before the event100% of the total booking price is payable

5.3 Where amounts already paid are less than the applicable cancellation charge, the Client remains responsible for paying the outstanding amount.

5.4 Where amounts already paid exceed the applicable cancellation charge, any refund due will be considered in accordance with these Terms & Conditions and applicable consumer law.

5.5 Cancellation charges reflect the fact that we reserve the date, allocate equipment and staff, make preparations and may decline other bookings for the same date.

5.6 Where legally required, cancellation charges will be limited to a reasonable amount reflecting our actual or reasonably foreseeable loss and costs, taking into account any loss we are able to mitigate by rebooking the date or services.

5.7 Nothing in this section is intended to remove or restrict any statutory consumer rights that cannot legally be excluded.

6. RE-BOOKING A CANCELLED DATE

6.1 If a Client cancels a booking and subsequently wishes to book another date, the new booking will be subject to availability and may require a new deposit or payment arrangement.

6.2 We are not required to transfer payments from a cancelled booking to a new date unless we agree to do so in writing.

6.3 Any agreed transfer may be subject to an administration charge or adjustment to reflect differences in services, pricing or availability.

7. RESCHEDULING

7.1 Requests to move an event to another date will be considered subject to availability.

7.2 Rescheduling is not guaranteed.

7.3 If we are unable to accommodate the requested new date, the booking may be treated as a cancellation by the Client.

7.4 A new date may be subject to different pricing where our prices, supplier costs or service requirements have changed.

8. CHANGES TO SERVICES

8.1 Requests to add, remove or change services should be made as early as possible.

8.2 Removing services may not result in a refund where the removal is made after equipment, staff, performers or other resources have been committed.

8.3 Additional services are subject to availability and additional charges.

8.4 Changes requested close to the event date may not be possible.

12. DELAYS CAUSED BY THE CLIENT OR VENUE

12.1 Our agreed service time does not include delays caused by the Client, venue or guests unless expressly agreed otherwise.

12.2 If we are prevented from setting up or providing the service because access is unavailable, delayed or restricted, we will make reasonable efforts to provide the service for as much of the booked period as reasonably possible.

12.3 We cannot guarantee that lost service time caused by access delays can be added to the end of the booking.

12.4 Where a significant delay prevents us from providing the service, we may be entitled to retain or charge the agreed booking price, subject to applicable law.

13. EQUIPMENT SAFETY

13.1 All equipment must be used only for its intended purpose.

13.2 The Client must ensure that guests do not misuse, move, interfere with or damage our equipment.

14.6 Where damage causes equipment to become unavailable and results in us being unable to fulfil another confirmed booking, we may also seek recovery of the reasonable, direct and unavoidable losses arising from that booking, where legally recoverable.

14.7 For example, if equipment is damaged at one event and, as a direct result, we are unable to fulfil a confirmed booking the following day or later that weekend, we may seek reasonable compensation for the resulting loss after taking reasonable steps to mitigate that loss.

14.8 We will not seek to recover the same loss twice.

14.9 We may request payment for damage after the event once the extent of the damage and resulting costs have been established.

15. DRY HIRE

15.2 The Client must ensure that equipment is used correctly and safely.

16.5 Where an outdoor service cannot safely proceed, we will discuss reasonable alternatives where possible.

16.6 We cannot guarantee that an alternative service or indoor location will be available.

17. THIRD-PARTY SUPPLIERS AND PERFORMERS

20.5 Guests must not deliberately damage, lift, move or interfere with the dancefloor.

20.6 Any damage or additional cleaning caused by guests will be chargeable to the Client.

21. CHILDREN'S ENTERTAINMENT

21.1 The Client remains responsible for the supervision and behaviour of children attending the event unless specific supervision has been expressly agreed as part of the service.

21.2 Parents, guardians or responsible adults must remain responsible for children where required.

24.2 No refund will automatically be due where we reasonably stop a service because of unsafe or unacceptable behaviour, subject to applicable law.

24.3 The Client is responsible for ensuring that guests behave appropriately.

25. STAFF AND PERFORMER SAFETY

25.1 Our staff, performers and contractors must be treated with respect.

25.2 We operate a zero-tolerance approach to threatening, abusive, violent or seriously inappropriate behaviour.

25.3 Where staff or performers reasonably believe that their safety is at risk, they may stop the service and/or leave the venue.

25.4 Additional costs or losses caused by abusive or unsafe behaviour may be recoverable from the Client where legally permissible.

26. DELAYS OUTSIDE OUR CONTROL

27.4 Nothing in these Terms & Conditions excludes liability that cannot legally be excluded.

28. FORCE MAJEURE

28.2 Such circumstances may include severe weather, flooding, fire, power failure, road closures, government restrictions, strikes, serious illness, accidents, venue closure, supplier failure, civil emergency or other unforeseeable events.

28.3 Where reasonably possible, we will discuss alternative arrangements with the Client.

38. BUSINESS CUSTOMERS

38.1 Where the Client is acting wholly or mainly for business purposes, certain consumer protections may not apply.

38.2 Different payment, cancellation and liability provisions may apply to business-to-business bookings where agreed in writing.

40.2 Certain services relating to leisure activities may be subject to specific dates or periods and may be treated differently under applicable consumer legislation.

40.3 Where the law gives the Client a cancellation right, nothing in these Terms & Conditions is intended to remove that right.

41. CHANGES TO THESE TERMS

41.1 We may update these Terms & Conditions from time to time.

41.2 The version applicable to a confirmed booking will generally be the version accepted when the booking was made, unless a change is required by law or otherwise agreed with the Client.

41.3 Updated Terms & Conditions will apply to future bookings.

42. NO WAIVER

42.1 If we do not immediately enforce a provision of these Terms & Conditions, this does not mean that we have waived our right to enforce it later.

43. ENTIRE AGREEMENT

43.1 These Terms & Conditions, together with the relevant invoice, booking confirmation and any written variations agreed with the Client, form the agreement between the parties in relation to the booking.

43.2 If there is a conflict between these Terms & Conditions and a specific written term on the Client's invoice or booking confirmation, the specific agreed term will take precedence to the extent of the conflict.

For booking enquiries, amendments, cancellations, complaints or other matters relating to these Terms & Conditions, please contact us using the contact details provided on our website, invoice or booking confirmation.

IMPORTANT NOTICE

These Terms & Conditions are intended to provide clear and robust protection for Mersey Entertainment while preserving the statutory rights of consumers.

Cancellation charges, damage charges and other amounts payable under these Terms & Conditions are intended to reflect reasonable costs and losses and are subject to applicable law.

Where a Client is a consumer, nothing in these Terms & Conditions is intended to create an unfair contract term or remove any legal right that cannot lawfully be excluded.

Mersey Entertainment reserves all rights available to it under applicable law.

The key figures are now built in: £50/up to 50% deposit, 28-day final balance, 12/8-week cancellation thresholds, variable overtime, and recovery of reasonable damage/cleaning and directly resulting losses such as a lost subsequent booking.

I’ve deliberately worded the damage section so it protects you without simply saying the client automatically owes any amount you choose—the latter can be problematic under UK consumer-contract rules. A solicitor should review the final version before you rely on it commercially.
